How is Child Support Determined?
Under New York law, the non-primary parent is required to pay child support to the primary parent. Child support is mandatory until the child turns 21 years old or is emancipated, but parents often come to a customized agreement that works for their unique situations. An example of this is when parents agree that support will continue for four consecutive years after high school to cover college expenses. By statutory formula, the payer party will be responsible for the following:
- 17 percent of gross income for one child
- 25 percent of gross income for two children
- 29 percent of gross income for three children
- 31 percent of gross income for four children
The courts will also consider expenses such as day care, insurance and education. Attorney Warren Welch has over 35 years of experience representing parents in child support determinations and will guide you through this complex process.
Finding Workable Child Custody and Visitation Arrangements
Determining custody and visitation can be a contentious issue that can stall divorce proceedings. Our firm encourages clients to work toward realistic situations that are best for the family.
Will Spousal Support be a Factor?
We can guide you through the complications of determining the amount and type of spousal support. Generally, the longer a marriage has lasted, the more spousal maintenance that will be awarded. Additionally, New York has the concept of "enhanced earnings" that take into account professional licenses, advanced degrees, businesses, pensions and other items contributing to additional income. It is important to hire a lawyer who has a full understanding of the law regarding support and all of the variables that come into play.
Is Relocation an Issue?
New York is very strict when it comes to relocation of a custodial parent. The court extensively considers many factors when one parent seeks permission to relocate with the children. Above all else, the final outcome is based on what will serve the best interests of the children.
Our firm handles requests for modification that arise in all support and custody matters.
