Understanding Grounds for Divorce

New York is the only state that requires fault to grant a divorce. If you have not been legally separated for one year, or if there is not voluntary agreement, then the person who wants the divorce must prove the other person's fault. There are six grounds for divorce which are as follows:

  • Abandonment for one year
  • Imprisonment for three years
  • Cruel and inhuman treatment
  • Living separate and apart pursuant to a valid decree of separation
  • Living separate and apart pursuant to a valid separation agreement
